Terms of service

These Terms of Service (“Terms”) are an agreement between you (“you,” “your,” or “Customer”) and ReadyCrate LLC (“ReadyCrate,” “we,” “us,” or “our”). By selecting the checkout acceptance box, placing an order, accepting delivery, or using rented equipment, you agree to these Terms. Please read them carefully. They describe your responsibilities, our payment authorization, and limits on liability.

1. The service

ReadyCrate rents reusable moving totes, dollies, and related equipment within the Kansas service area posted on readycrate.co, primarily in Johnson County, Kansas. We provide clean, empty equipment for use during a household, office, renovation, or organizational move or project. We are not a moving company and do not pack, lift, load, carry, transport, or store your belongings. Consumable supplies or products identified as sale items are sold to you and are not rental equipment.

2. Eligibility and authority

You must be at least 18 years old and legally able to enter into a contract. If you place an order for a business, property owner, tenant, client, or another person, you confirm that you have authority to accept these Terms and provide the delivery and pickup information on that party’s behalf.

3. Rental period and extensions

The standard rental period is 14 calendar days beginning on the delivery date and ending on the scheduled pickup date shown in your order confirmation. Extensions are subject to inventory and route availability. Request an extension before the scheduled pickup window. An extension is approved only after ReadyCrate confirms it and charges the posted extension fee to the payment method on file.

4. Orders, pricing, and taxes

Your order confirmation identifies the package, rental dates, delivery and pickup locations, delivery fee, and other selected items. Prices and disclosed fees are shown in your order, these Terms, or the pricing page in effect when you order. Applicable sales or use taxes are added when required by law. An order is accepted when ReadyCrate sends a confirmation. We may decline or cancel an order before delivery because of inventory, route capacity, unsafe access, inaccurate information, suspected fraud, or circumstances outside our reasonable control.

5. Payment and saved payment authorization

Payments are processed through Stripe. By placing an order and accepting these Terms, you authorize ReadyCrate and Stripe to save a payment-method reference and charge that payment method for:

  • the rental price, delivery fee, taxes, and purchased supplies shown at checkout;
  • an extension that you request and ReadyCrate approves;
  • a disclosed re-delivery, missed-pickup, overdue, extraordinary-cleaning, disposal, damage, missing-equipment, or replacement charge allowed by these Terms; and
  • any other amount you separately approve in writing or through the website.

We keep the payment-method reference until the order is closed and authorized charges or disputes are resolved, generally no longer than 60 days after closeout unless you separately choose to save it for future orders. Before a charge that was not paid at checkout, we will send notice describing the charge and will provide a receipt after processing. If a charge is declined, you remain responsible for the amount due and must provide another valid payment method.

6. Cancellation and rescheduling

You may cancel without charge until 48 hours before the scheduled delivery window. A $50 cancellation fee applies to cancellations made within 48 hours of that window. You may request one reschedule without a fee when you give at least 24 hours’ notice, subject to route and inventory availability. Additional or late changes may require a re-delivery or off-window fee shown before you approve the change.

If an adult is not available when required and contactless delivery was not approved, a $25 re-delivery fee applies. If ReadyCrate cancels before delivery and cannot offer a mutually acceptable replacement date, we will refund amounts paid for the affected order.

7. Delivery, contactless delivery, and inspection

An adult 18 or older must be present at first delivery unless ReadyCrate approves contactless delivery in advance. Delivery and pickup are made to the nearest safe, ground-level accessible point, such as a garage, porch, driveway, lobby, or building entrance. We do not carry equipment inside a home or up or down stairs unless a separate written arrangement says otherwise.

At attended delivery, you must confirm the count and note visible damage before we leave. For approved contactless delivery, ReadyCrate may use timestamped photographs and inventory records to document the delivered count, location, and visible condition. You must report a count discrepancy or pre-existing damage within 24 hours after delivery. If you do not, our delivery record will be treated as accurate unless you provide reasonable evidence otherwise.

You are responsible for providing accurate addresses, access instructions, permissions, codes, parking information, and a safe, clear, lawful route to the delivery and pickup point. If access is unsafe, blocked, unlawful, or materially different from what you disclosed, we may reschedule and charge the applicable re-delivery or extra-route fee.

8. Equipment ownership

All rented totes, dollies, and other rental equipment remain ReadyCrate property. You receive only a temporary right to use them during the rental period. You may not sell, sublet, lend, pledge, alter, permanently mark, transfer, or release rental equipment to anyone other than ReadyCrate. Ownership of consumable or sale items transfers to you when paid for.

9. Proper use and care

Use rental equipment only for its intended purpose and in a careful, lawful manner. Do not overload equipment or exceed any marked capacity. Keep equipment under your control, protected from theft, standing water, extreme heat, fire, pests, and avoidable weather exposure. Do not use it for hazardous, illegal, explosive, flammable, toxic, corrosive, perishable, leaking, wet, pest-infested, or unsanitary materials, or for any item likely to injure someone or damage the equipment.

10. Pickup preparation and abandoned contents

Before the pickup window, all equipment must be empty, reasonably clean, closed, stacked or nested as instructed, and placed at the agreed accessible pickup point. If equipment is not ready or accessible, a $25 missed-pickup fee may apply, the rental may continue at the posted weekly extension rate, and another pickup will be scheduled based on route availability.

Remove all personal property before pickup. If we find an item left inside, we may contact you and make it available for retrieval for up to seven days when reasonably practical. We may immediately dispose of perishable, hazardous, unsanitary, leaking, or low-value items. ReadyCrate is not responsible for belongings left in returned equipment except to the extent required by law. You are responsible for reasonable disposal costs caused by prohibited or abandoned contents.

11. Damage, extraordinary cleaning, and missing equipment

We count and inspect equipment at delivery and pickup. Ordinary wear from normal, permitted use is our responsibility. You are responsible for loss and for damage beyond ordinary wear while equipment is in your possession, including cracked lids, broken hinges, punctures, burns, unauthorized markings, avoidable water damage, contamination, pest exposure, or damage caused by prohibited contents or misuse.

Current replacement fees are:

  • Tote: $30 each.
  • Dolly: $100 each.

For extraordinary cleaning, decontamination, disposal, or repair, we may charge the reasonable actual cost, not exceeding the applicable replacement fee for the affected item. We will identify the item and reason for the charge. For missing equipment, we will provide notice and a 48-hour grace period to locate it before charging the replacement fee. We will not charge both a repair or cleaning fee and the full replacement fee for the same item.

12. Unreturned and overdue equipment

If equipment is not returned on the scheduled pickup date and no extension has been approved, the rental continues at the posted weekly extension rate until the equipment is returned or deemed lost. If equipment remains unreturned 30 days after the scheduled pickup date and you have not maintained reasonable communication with us, ReadyCrate may deem it lost and charge the replacement fee in Section 11. A replacement charge does not transfer ownership unless ReadyCrate confirms the transfer in writing.

13. Your belongings and third parties

You decide what to place in the totes and how to pack, lift, stack, load, transport, unload, and unpack them. ReadyCrate does not take custody of your belongings and is not responsible for the acts or omissions of movers, helpers, landlords, building staff, drivers, or other third parties. Our totes are sturdy and water-resistant, but they are not waterproof, climate-controlled, burglar-proof, or a guarantee against damage during packing, storage, or transportation.

14. Limitation of liability

Please read this section carefully. It limits ReadyCrate’s liability to the fullest extent permitted by Kansas law.

ReadyCrate’s total liability for any claim arising out of or related to an order, rental, equipment, website, or these Terms, whether based on contract, warranty, negligence, or another theory, will not exceed the total rental and delivery fees you paid for the order giving rise to the claim.

To the fullest extent permitted by law, ReadyCrate will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, lost data, or loss of use; or damage to, loss of, or theft of belongings packed, stored, or moved with the equipment, even if we were advised that such damage was possible.

Nothing in these Terms excludes or limits liability for ReadyCrate’s fraud, willful misconduct, or personal injury or property damage caused by ReadyCrate’s own negligence, or any warranty, remedy, or liability that applicable law does not allow us to exclude or limit.

15. Assumption of risk

Packing, lifting, carrying, stacking, loading, and moving totes and dollies involves physical activity and risk. You are responsible for deciding whether you and anyone you permit to use the equipment can do so safely. You assume the risks arising from your packing, lifting, loading, transportation, storage, and use of the equipment, except to the extent an injury or loss is caused by ReadyCrate’s own negligence or other conduct for which liability cannot lawfully be limited.

16. Indemnification

To the fullest extent permitted by Kansas law, you agree to indemnify and hold harmless ReadyCrate LLC and its owners, employees, and agents from third-party claims, damages, losses, liabilities, and reasonable costs, including attorney fees, arising from your prohibited or negligent use of the equipment, your breach of these Terms, or injury to a person or damage to property while the equipment is in your possession. This obligation does not apply to the extent a claim is caused by ReadyCrate’s own negligence, fraud, or willful misconduct.

17. Communications

By providing your phone number or email address, you agree that ReadyCrate may contact you about a quote, order, delivery, pickup, extension, equipment issue, payment, safety matter, or customer-support request. Messages may be sent by email, phone call, or text, and message and data rates may apply. Marketing messages require separate consent where required. You may opt out of non-essential marketing at any time, but we may still send transactional communications needed to administer an active or recent order.

18. Privacy

Our collection and use of personal information are described in the ReadyCrate Privacy Policy posted at readycrate.co. The Privacy Policy may be updated separately from these Terms to reflect changes in our data practices or service providers.

19. Force majeure

ReadyCrate is not responsible for delay or failure to perform caused by events beyond our reasonable control, including severe weather, natural disaster, fire, utility or internet outage, road closure, accident, government action, labor disruption, vehicle breakdown despite reasonable maintenance, or another emergency. We will communicate when practical and work with you to reschedule the affected delivery or pickup.

20. Changes to these Terms

We may update these Terms from time to time. The version accepted when you place an order governs that order unless you and ReadyCrate agree otherwise in writing. The current version is posted at readycrate.co.

21. Governing law and venue

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-laws rules. Except where mandatory law permits or requires another forum, a dispute arising out of or related to these Terms or a rental must be brought in the state or federal courts located in Johnson County, Kansas, and each party consents to the jurisdiction of those courts.

22. Severability and entire agreement

If a provision is unenforceable, it will be limited or removed only as necessary, and the remaining provisions will stay in effect. A failure to enforce a provision is not a waiver. You may not assign an order without our written consent. ReadyCrate may assign these Terms in connection with a merger, financing, reorganization, or sale of the business. These Terms, your order confirmation, accepted pricing and fee disclosures, and written changes agreed by both parties form the entire agreement concerning the rental.
